1. Acceptance

By using Voctale you accept these Terms of Service. If you do not accept, do not use the service. Voctale is operated by Itamde — 12 avenue de la Gare, 38144 Notre Dame de Vaulx, France — contact@voctale.com.

2. Service description

Voctale is an interactive audiobook platform that provides: streaming of linear, interactive, and podcast audiobooks; single purchases, subscription credits, or promo codes; content publishing by authors and contributors.

3. User accounts

You must be at least 13 years old (or the legal minimum age in your country) to create an account. You are responsible for: the confidentiality of your password; all activities performed from your account; providing accurate and up-to-date information. We reserve the right to suspend or delete any account in case of violation.

4. Purchases, prices, and VAT

Displayed prices include applicable VAT based on your country of residence (EU OSS scheme). You can purchase:

• Individual audiobooks — lifetime access
• Monthly subscriptions (€8.99/month — 1 credit) or annual (€99.99/year — 12 credits)
• Gift cards that top up your Voctale wallet

Unused subscription credits survive cancellation for audiobooks already redeemed, but expire with the end of the paid period for those not yet used.

5. Subscriptions — cancellation and plan change

You can at any time:

• Cancel your subscription from /subscriptions → effective at the end of the current period, you keep access until then
• Switch plan (monthly → annual or vice versa) with automatic pro-rata calculation by Stripe
• Resume a cancelled subscription before the end of the period

6. Right of withdrawal (14 days)

In accordance with consumer law, immediate access to digital content constitutes an express waiver of the right of withdrawal. By purchasing an audiobook and starting playback, you waive your right of withdrawal. The refund policy below remains applicable.

See the Refund Policy for details. Summary: refund possible within 30 days if content has not been listened to over 50%; not combinable with a used promo code.

8. Intellectual property

Audiobooks, texts, illustrations, music, and all other content are copyright-protected. You purchase a personal, non-transferable, non-exclusive listening license. Prohibited: unauthorized download, redistribution, resale, integration into other services, circumventing technical protection measures (DRM/signed URLs).

9. Author and contributor content

Registered authors retain intellectual property of their works. By publishing on Voctale they grant Itamde a non-exclusive license to distribute, stream, and commercialize. Commercial details (commission percentage, payment terms, duration) are governed by a separate contract between the author and Itamde.

10. Author payouts

Authors receive a commission on every sale and subscription credit redemption. Payouts are made according to the method chosen by the author: Stripe Connect (automated transfer), bank transfer (SEPA), PayPal, or Voctale wallet credit. A minimum threshold (€50 default, adjustable by the author) applies.

11. Prohibited conduct

Prohibited: violating others' rights; publishing illegal, defamatory, hateful, pornographic, or IP-infringing content; circumventing technical limitations (DRM, session and stream limits); using bots or automated scripts; creating multiple accounts to bypass restrictions; attempting unauthorized system access.

12. Moderation and sanctions

We may remove any content or account in case of violation. Graduated sanctions include: warning, content hiding, temporary suspension, permanent ban. Moderation decisions can be appealed by email to contact@voctale.com.

13. Limitation of liability

Voctale is provided "as is". We do not warrant absence of interruptions, errors, or data loss, although we do everything possible to avoid them. Our liability, except for mandatory legal obligations, is limited to the amount you paid in the last 12 months.

14. Termination

You may delete your account at any time via /profile → Account → Delete my account. We may suspend or terminate your account in case of serious violation, with prior notice except in emergencies.

15. Governing law and jurisdiction

These Terms are governed by French law. Any dispute falls exclusively within the jurisdiction of the French courts of Itamde's registered office, subject to mandatory consumer-protection legal provisions. Before any legal action, we encourage amicable resolution via contact@voctale.com. European online dispute resolution platform: ec.europa.eu/consumers/odr.

16. Changes to the Terms

We may modify these Terms. Any material change will be notified by email 30 days before taking effect. Continued use after that date constitutes acceptance.
